1. Agreement
This agreement constitutes the entire understanding between The Forever Captured Studio (“The Company” / “The Content Creator”) and the Clients (Bride and Groom). It supersedes all prior discussions, agreements, or communications.
2. Booking & Confirmation
A signed booking form and non-refundable retainer are required to secure your wedding date
The remaining balance must be paid no later than four (4) weeks prior to the wedding date
Failure to complete payment may result in cancellation of services
3. Cooperation & Client Responsibilities
To ensure the best possible results, both parties agree to cooperate fully.
The Clients agree to:
- Provide a clear schedule and notify the Content Creator of key moments (e.g., speeches, cake cutting, first dance)
- Assist in identifying important individuals when required
- Provide a meal if coverage exceeds six (6) hours (or notify in advance if not provided)
- Inform guests that photography and videography will be taking place
Important:
- Not all moments or guests can be guaranteed to be captured
- The Company is not responsible where guests decline to be filmed or photographed
- The Company is not liable for circumstances beyond reasonable control
4. Schedule & Timing
- Punctuality and cooperation are essential for successful coverage
- If the event runs significantly behind schedule, full coverage cannot be guaranteed
- The Content Creator will make every reasonable effort to accommodate delays
5. Creative Style & Editing
- All content is filmed and edited in The Forever Captured Studio’s signature modern style
- Final editing decisions remain at the sole discretion of the Company
6. Guest Interference
Guests are respectfully asked to allow the Content Creator priority during key moments.
The Company is not responsible for:
- Missed content due to guest interference
- Obstructed views caused by phones, cameras, or crowding
7. Venue & External Restrictions
- Coverage is subject to venue, registrar, officiant, or location restrictions
- The Company is not responsible for limitations imposed by venues or officials
- Any resulting technical limitations are accepted by the Clients
8. Copyright & Usage
- All photos, videos, and footage remain the intellectual property of The Forever Captured Studio
- Clients receive a personal content, including sharing and printing rights
- Content may not be sold, edited, or used commercially without written permission
9. Model Release & Promotional Use
- The Clients grant The Company permission to use images and footage for:
- Social media
- Website portfolio
- Marketing and promotional materials
- Clients may opt out in writing prior to the event
10. Limitation of Liability
- In the event the Content Creator cannot attend due to illness, emergency, or unforeseen circumstances:
- A suitable replacement will be arranged where possible
- If not, liability is limited to a full refund of fees paid
- In the unlikely event of:
- Loss, corruption, or damage to files beyond control
- Equipment failure
Liability is limited to the amount paid for the affected services.
11. Cancellation & Retainer
- The retainer is non-refundable under all circumstances
- If the Client cancels, all payments made remain non-refundable
- If The Company cancels, a full refund will be issued
Postponements:
- In cases such as government restrictions, bookings may be transferred to a new date
- This is subject to availability and may be subject to updated pricing
12. Content Creator Assignment
- Coverage will be provided by The Forever Captured Studio and an assigned Content Creator
- The assigned Content Creator will be confirmed prior to the event
- The Content Creator holds valid Public Liability Insurance, available upon request by the Client or event organisation or wedding venue
13. Delivery of Content
- All content is delivered via digital download
- Wedding reels and key content are typically delivered within 2–3 days, workload permitting
- Full galleries and final edits will follow within the agreed timeframe
Client Responsibility:
- Clients are responsible for downloading and securely storing their content
- We recommend backing up files to multiple locations (device, USB, cloud storage)
14. Data Protection & Privacy
All personal data and content are handled in accordance with our Privacy Policy.
15. Acceptance
By booking The Forever Captured Studio, you confirm that you have read, understood, and agreed to these Terms & Conditions.
